First-refusal right set aside for exchange

The amendment sets aside Fort Lupton’s 45-day first right of refusal for the proposed land exchange involving Tricycle Lane Texas, LLC’s 155.92-acre property and Public Service Company of Colorado. The right, granted under the April 16, 2024, annexation agreement, lets the city buy the property for water storage if its final reclamation is to be a water-storage reservoir; the city retains the right for later transactions, and the rest of the agreement remains in force. Public Service Company of Colorado will continue working with the city on additional recreational opportunities beyond those required by the original annexation and mining special use permit. The ordinance was published by title only on October 15, 2026, and takes effect November 14, 2026. The amendment becomes null and void if the transfer is not completed within 5 years of its execution.
