$65,000 settlement resolves former employee claims

From the Greeley City Council meeting of

The resolution authorizes city staff to sign a settlement with former Assistant Records Manager Kathryn Sienkowski over her discrimination charge and related potential claims. The agreement calls for Greeley to pay $65,000.00 in two checks of $32,500.00 each: one reported on a W-2 and subject to federal, state and local tax withholdings, and the other reported on a 1099 for alleged personal injury, emotional distress and non-economic harm. Payment is due 30 days after the later of council approval and the end of Sienkowski’s seven-day revocation period, if she has not revoked the agreement, and depends on her attorney filing a dismissal of her lawsuit with prejudice. The agreement releases the city and its current and former personnel and representatives from claims based on earlier acts or omissions, subject to exceptions for claims that cannot legally be waived and certain indemnification rights. It also preserves any retirement or pension benefits to which Sienkowski is entitled.

Adopted with the consent agenda (carried, 7-0).
