Annexation agreement would set disconnection terms

From the Fort Collins City Council meeting of

The ordinance would authorize Mayor Emily Francis to sign Cottonwood Land and Farms, LLC’s agreement for the approximately 147.499-acre Strauss Lakes property. After annexation documents are recorded, Cottonwood could request disconnection if the requested zoning or service plan is denied, staff refuses to present the service plan, the ODP is denied or approved with conditions Cottonwood finds unacceptable, either plan remains unapproved 18 months after the effective date, or a first-phase application is denied within five years. Cottonwood would have 90 calendar days after a disconnection event to submit a written request. A timely request would require the Council to adopt a disconnection ordinance on second reading within 90 calendar days; the request alone would suffice, without requiring a finding that disconnection would not prejudice the City’s best interests. The right would end if Cottonwood failed to submit a service plan within nine months or a complete first-phase application within 18 months after the effective date.
