The final plat is generally located south of and adjacent to Buss Grove Road and east of and adjacent to Timnath Parkway. The property contains 3,450,898 square feet, or 79.22 acres, more or less. The final plat’s land-use summary lists 16.560 acres of open space, equal to 20.903% of the total area. The staff report says the open-space network includes a pocket park and areas intended for passive and active recreation.
The council approved the final plat with a condition allowing staff to work with the owner-applicant on minor, non-substantive modifications before final signatures. A second condition barred recording the plat until the lateral relocation agreement was fully executed. A third condition required applicable measures to protect bald eagles, migratory birds and other active nests before and during nesting season, with construction-timing, monitoring and habitat-protection protocols to be approved by the town before construction begins. Staff said the council’s review was the final stage of the major subdivision process, with site plans or building permits and infrastructure construction to follow.
The applicant said an amendment to the subdivision improvement agreement requires the neighborhood park and rec center to be built before the 30th certificate of occupancy is issued in Filing No. 9. Staff said the facilities must go through the site-plan process and be constructed by the time the 30th occupancy in the filings is reached.
The applicant said the rec center and neighborhood park off Harmony had been contemplated as Phase 3 improvements, but the original entitlements did not specify when or whether they had to be built. The applicant said he had consistently told homebuilders the facilities would be a Phase 3 improvement, with timing dependent on market conditions and Phase 3 sales and construction. The applicant said completing the facilities in 2027 would probably be difficult, while 2028 was a reasonable expectation. Council Member Jeramie Holt said every home had been sold with a promise of a rec center and sports fields and called the pitch “Very bait and switch.”
The existing subdivision improvement agreement deems eight well owners to have given notice that their wells were impacted. Under the existing subdivision improvement agreement, the developer must replace or relocate registered wells for those eight owners and any other eligible owners who give notice by May 9, 2027, or reach a compensation agreement with the owners. The applicant said the developer would replace the wells of the nine owners it had identified as qualifying without requiring them to object first. The applicant said owners had two years after completion of the lakes to object to potential well impacts, with the objection period expiring May 9, 2027.
Council Member Dennis Strachota said he wanted more information about whether the other 11 property owners qualified for compensation or well replacement and requested a specific date for resolving the well issue. Staff said a condition tied to the Timnath Landing augmentation pond was already in place to remedy effects on wells, but the staff member did not know whether it specified a date. Mayor Pro-Tem Luke Wagner asked that residents be notified again about the upcoming period related to the wells.
